BAY AREA COATINGS, LLC WORKING AGREEMENT

The following terms, agreements, and conditions set forth below, including a limited warranty provided by Bay Area Coatings, LLC, shall govern both the customer and Bay Area Coatings, LLC as it pertains to the work to be provided by Bay Area Coatings, LLC. 

GENERAL TERMS AND AGREEMENTS

Please remove all loose and/or personal items from the room BEFORE technician(s) arrives to do the refinishing. This includes curtains, pictures, accessories, rugs, etc. Bay Area Coatings, LLC and its agents are not liable for any damage to said items. Further, the customer is responsible for any additional time incurred resulting from removal said items from the room before work can begin. Make sure lights, water, power and parking are available. 

RESCHEDULING AND CANCELLING APPOINTMENTS

If you need to reschedule or cancel your appointment, you must do so within a minimum of 2 business days in advance. Appointments not cancelled with proper notice will result in a cancelation fee of $120.00. Exceptions may apply.

PAYMENT IS DUE UPON COMPLETION OF WORK. Bay Area Coatings, LLC accepts CASH, CHECK OR CREDIT CARD. When possible, the customer should be present to inspect the work at its completion. Payment must be made or set terms at the completion of work. Certain jobs may require a deposit in advance. In these cases, the unpaid balance is due upon completion. Interest, late fees, processing fees, collection fees, and legal fees may be added to any past due balances. A Mechanic’s Lien can be filed for any amounts owed, including interest, processing fees, collection fees, and legal fees.

COLOR AND TEXTURE

It is highly recommended that the customer take care in choosing any color for any job provided by Bay Area Coatings, LLC. Once applied, the color cannot be changed except by reapplying new materials at the customer’s expense. Bay Area Coatings, LLC offers a variety of color options.  Custom colors require extra time and an additional fee. 

LIMITED WARRANTY: TERMS AND CONDITIONS

This limited warranty is provided by Bar Area Coatings, LLC for work, specified below, performed by Bay Area Coatings, LLC. In addition to the terms and conditions set forth below, the limited warranty is subject to any other conditions stated in the invoice.  

Bathtubs, enclosures, shower stalls, wall tiles, counters, floors and vanities are all warranted against the failure of adhesion (non-commercial use only) caused by an incorrect process of application or defective product of the applied finish for a period of five (5) years. The 5 years warranty will be pro-rated over the 5 years on a yearly basis with changes in the pro-rated amount taking place on the anniversary date of acquisition. The coverage will be 100% during the first year and after that 40% for the remaining 4 years of the limited warranty.   

To redeem disclosed limited warranty, a warranty claim must be submitted to and verified by Bay Area Coatings, LLC within the (5) five-year period following the completion of the work. The claim must include the original invoice number for the job done to prove that said job was in fact performed by Bay Area Coatings, LLC. Bay Area Coatings, LLC may, at its own discretion, accept other documentation or proof that said work was in fact performed by Bay Area Coatings, LLC. This discretion will be reasonable and not prejudicial to any legitimate warranty claims. 

Sinks, soap holders, spot repairs, slip resistant surfaces and other miscellaneous refinished surfaces are not warranted. In addition, caulk, rust stains, plumbing, reoccurring rust, mildew, mold, or a perpetually wet surface due to bath mats (without drying out between uses), improper drainage, leaking/dripping plumbing or standing water for extended periods of time or the use of chemicals, hair dyes, or other products that may stain or damage the finish are not warranted. Please note that chipping, scratching, cut marks, impact damage or superficial damage caused by movement in the substructure that may cause movement in the refinished surface resulting in a crack or split in the refinished surface, caulking or grout lines are not warranted. Any damage not directly attributable to the work performed by Bay Area Coatings, LLC, is not covered under this limited warranty. These damages can typically easily be repaired, and Bay Area Coatings, LLC will repair them at the customer’s request and expense. 

BAY AREA COATING, LLC Policy

PLUMBING:

Our technicians are not certified or licensed plumbers. They are not trained, equipped or authorized to do plumbing. If any drains, pipes or plumbing hardware are removed or adjusted at the customer’s request, it is done so only as a courtesy and the customer agrees to defend, indemnify, and hold harmless Bay Area Coatings, LLC from any resulting damage, personal injury, and/or subsequent costs of any kind related to any plumbing work.  

 MASKING:

Bay Area Coatings, LLC will take precautions as best they can to avoid any damage to the customer’s walls or floors during the installation and removal of masking tape. However, Bay Area Coatings, LLC does not take any responsibility for any damage to any paint, wall coverings, or floors and the customer agrees to defend, indemnify and hold harmless Bay Area Coatings, LLC from any resulting damage or subsequent costs of any kind related to removing masking tape.  

 APPLIANCES:

Moving kitchen appliances can damage flooring. The customer is responsible for moving any appliances prior to any work that may be done. If any appliance is moved by us at the customer’s specific request, then the customer agrees to defend, indemnify, and hold harmless Bay Area Coatings, LLC from any damage or subsequent costs of any kind related to moving said appliances.  

 ODORS:

There is an odor that accompanies the refinishing process. If the customer is sensitive to solvents or paint-type smells, then the customer should remain out of the immediate area during the spraying. The customer agrees to bear its own damages and costs and to defend, indemnify, and hold harmless Bay Area Coatings, LLC for any damages or costs related to the odors generated by work performed by Bay Area Coatings, LLC, including, but not limited to, move out costs or hotel/motel/inn rental costs. 

SLIP OR FALL DISCLAIMER:

Some coatings may cause surfaces to be more slippery. Bay Area Coatings, LLC offers the application of a slip resistant texture or bathmat to reduce the possibility of injury, which may occur from slipping or falling.  Bay Area Coatings, LLC makes no representation or warranty that the offered slip resistant texture will prevent slipping or falling, or damage incurred there from. The customer agrees to bear its own damages and costs and to defend, indemnify and hold harmless Bay Area Coatings, LLC form any claim, liability, and/or damage resulting from any slip or fall which may occur on or near a refinished surface, including any surface treated with a slip resistant texture or bathmat.
